Why Would You Choose Mediation To Resolve An Issue?

Costs

The financial costs of taking a dispute to court can be excessively expensive. The emotional costs of taking the dispute to court can be great with long lasting effects because the courts operate on the adversarial system where there is usually a winner and a loser. Mediation is directed at finding a mutually acceptable solution where both parties win.

Confidentiality

Mediation provides maximum confidentiality to all parties involved. Once an agreement has been reached or not reached by the parties in dispute, no records of the process are maintained and entered into an employee’s employment file.

On the other hand should an employee choose to enter into the grievance process, an investigation is carried out and the record and results of the investigation are kept on an employee’s file for a period of time. There is also the concern of possible repercussions.
